A Utah man is charged with rape after police said he threatened to call ICE on a woman before allegedly sexually assaulting her.

According to a probable cause affidavit obtained by PEOPLE, South Salt Lake police alleged that the man had coerced the woman to have sex with him against her will at least once a week since June 2025.

The suspect, 57, who police said has a daughter with the alleged victim, is accused of threatening to take custody of their child and saying he would contact immigration enforcement on the “victim and her family, which he believed would help him gain custody of the child,” police said in the affidavit. PEOPLE is not identifying the suspect to protect the daughter’s privacy.

Police cited a specific incident in April, during which the suspect allegedly told the woman that they had to talk about their daughter.

The man allegedly threatened her, demanding that they have sex or else he would take their daughter away, the affidavit stated.

The woman feared for her safety and complied, police alleged, and she was subsequently taken to a hotel and forced to take a shower.

According to police, when the woman got out of the shower, the suspect allegedly forced himself on her.

“During the process of the rape, the victim told the [suspect] several times to stop because she did not want to have sexual relations with him, but the [suspect] continued,” police alleged.

The man was arrested on Tuesday, May 12 in South Salt Lake, Utah, and charged with rape and sexual extortion. It is not immediately clear if he has entered a plea.
